Have you forgotten that the justification for incarcerating these people in Guantanamo, far away from human rights, Geneva Convention and legal aid was that they are not in fact prisoners of war, but in fact "non-combattants"? Making them war criminals would necessitate all kinds of shit so far conveniently ignored.
